বিষয়: উত্তৰাধিকাৰৰ সম্পত্তিৰ বিতৰণ (Distribution of inherited property):

এই বিষয়বস্তুৰ টোকা একেলগে ৪:১১ত দিয়া হৈছে।

ওপৰৰ ভিদিঅ'টোত ছুৰা নিছাৰ ৪:৭-১১ নং আয়াতলৈ আছে। কিন্তু আমাৰ বিষয় বস্তুৰ আলোচনাৰ বাবে ১২,১৭৬ নং আয়াতৰো প্ৰয়োজন হ'ব। অৰ্থাৎ আমাৰ ছুৰা নিছাৰ পৰা আয়াতৰ প্ৰয়োজন ৪:৭, ৪:৮, ৪:১১, ৪:১২, ৪:১৭৬।

💚৪:৭(Women's Inheritance Rights).

لِلرِّجَالِ نَصِيبٌ مِمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ وَلِلنِّسَاءِ نَصِيبٌ مِمَّا تَرَكَ الْوَالِدَانِ وَالْأَقْرَبُونَ مِمَّا قَلَّ مِنْهُ أَوْ كَثُرَ ۚ نَصِيبًا مَفْرُوضًا

পিতৃ-মাতৃ আত্মীয়-স্বজনৰ পৰিত্যক্ত সম্পত্তিত পুৰুষৰ অংশ আছে আৰু পিতৃ-মাতৃ লগতে আত্মীয়-স্বজনৰ পৰিত্যক্ত সম্পত্তিত নাৰীৰো অংশ আছে, সেয়া কমেই হওঁক বা বেছিয়েই হওঁক, এইটো নিৰ্ধাৰিত অংশ।

📍Verse/Note:

4:7 The men get a share of what the parents and the relatives leave behind. The women too shall get a share of what the parents and relatives leave behind. Whether it is a small or a large inheritance, (the women must get) a definite share(rk)(+4:12).

💚৪:৮

وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَىٰ وَالْيَتَامَىٰ وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ وَقُولُوا لَهُمْ قَوْلًا مَعْرُوفًا

আৰু সম্পত্তি বন্টন কৰা অৱস্থাত আত্মীয়, ইয়াতীম আৰু ⚡অভাৱগ্ৰস্ত লোক উপস্থিত থাকিলে সিহঁতক তাৰ পৰা অলপ হ'লেও প্ৰদান কৰিবা আৰু সিহঁতৰ লগত সদালাপ কৰিবা।

📍Verse/Note:

4:8 And when [other] near of kin and orphans and needy persons ⚡are present at the distribution [of inheritance], give them something thereof for their sustenance, and speak unto them in a kindly way.

I.e., ⚡people who do not have any legal claim to the inheritance, but nevertheless deserve to be considered(as).

💚৪:৯

وَلْيَخْشَ الَّذِينَ لَوْ تَرَكُوا مِنْ خَلْفِهِمْ ذُرِّيَّةً ضِعَافًا خَافُوا عَلَيْهِمْ فَلْيَتَّقُوا اللَّهَ وَلْيَقُولُوا قَوْلًا سَدِيدًا

আৰু সিহঁতে ভয় কৰা উচিত যে, যদি সিহঁতে নিজৰ পিছত নিঃসহায় সন্তান এৰি থৈ যায় তেন্তে সিহঁতেও সিহঁতৰ বিষয়ে উদ্বিগ্ন হ’লহেঁতেন। এতেকে সিহঁতে যেন আল্লাহৰ তাক্বৱা অৱলম্বন কৰে আৰু সঙ্গত কথা কয়।

📍Verse/Note:

4:9 (The distribution of inheritance must be done responsibly. Treat others, as you would like to be treated.) The disposers of inheritance must fear as they would fear injustice done to their own children if left behind. So, be mindful of God and speak clearly and straight to the point. [33:70](sa).

(৩৩:৭০

يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَقُولُوا قَوْلًا سَدِيدًا

হে ঈমান্দাৰসকল! তোমালোকে আল্লাহৰ তাক্বৱা অৱলম্বন কৰা আৰু সঠিক কথা কোৱা;)।

💚৪:১০

إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَىٰ ظُلْمًا إِنَّمَا يَأْكُلُونَ فِي بُطُونِهِمْ نَارًا ۖ وَسَيَصْلَوْنَ سَعِيرًا

নিশ্চয় যিসকলে ইয়াতীমসকলৰ সম্পদ অন্যায়ভাৱে গ্ৰাস কৰে, দৰাচলতে সিহঁতে নিজৰ পেটত অগ্নি ভৰাই লয়। অনতিপলমে সিহঁতে প্ৰজ্জ্বলিত জুইত প্ৰৱেশ কৰিব।

4:10 Those who consume the orphans' properties unjustly, eat fire into their bellies, and will suffer in Hell.

💚৪:১১-১২(একেলগে চাব)👈

يُوصِيكُمُ اللَّهُ فِي أَوْلَادِكُمْ ۖ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ ۚ فَإِنْ كُنَّ نِسَاءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَ ۖ وَإِنْ كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ ۚ وَلِأَبَوَيْهِ لِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ مِمَّا تَرَكَ إِنْ كَانَ لَهُ وَلَدٌ ۚ فَإِنْ لَمْ يَكُنْ لَهُ وَلَدٌ وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ ۚ فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ ۚ مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ ۗ آبَاؤُكُمْ وَأَبْنَاؤُكُمْ لَا تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعًا ۚ فَرِيضَةً مِنَ اللَّهِ ۗ إِنَّ اللَّهَ كَانَ عَلِيمًا حَكِيمًا

আল্লাহে তোমালোকক তোমালোকৰ সন্তান সম্পৰ্কে এই নিৰ্দেশ দিছে যে, এজন পুত্ৰৰ অংশ দুজনী কন্যাৰ অংশৰ সমান; কিন্তু যদি কেৱল দুজনীতকৈ বেছি কন্যা থাকে তেন্তে তেওঁলোকৰ বাবে পৰিত্যক্ত সম্পত্তিৰ তিনি ভাগৰ দুভাগ, আৰু কেৱল এজনী কন্যা থাকিলে তেন্তে তাইৰ বাবে অৰ্ধাংশ। সন্তান থাকিলে (মৃত ব্যক্তিৰ) পিতৃ-মাতৃ উভয়ৰে পৰিত্যক্ত সম্পত্তিৰ ছয় ভাগৰ এভাগ; সি (মৃত ব্যক্তি) নিঃসন্তান হ’লে আৰু পিতৃ-মাতৃ উত্তৰাধিকাৰী হ’লে তাৰ মাকৰ বাবে তিনি ভাগৰ এভাগ; আৰু যদি তাৰ ভাই-ভনী থাকে তেনেহ’লে মাকৰ বাবে ছয় ভাগৰ এভাগ; এইবোৰ বন্টন হ’ব তাৰ অছিয়ত আৰু ঋণ পৰিশোধ কৰাৰ পিছত। তোমালোকৰ পিতা আৰু সন্তানসকলৰ মাজত কোন বেছি উপকাৰী সেয়া তোমালোকে নাজানা। এই বিধান আল্লাহৰ; নিশ্চয় আল্লাহ সৰ্বজ্ঞ, প্ৰজ্ঞাময়।

৪:১২

۞ وَلَكُمْ نِصْفُ مَا تَرَكَ أَزْوَاجُكُمْ إِنْ لَمْ يَكُنْ لَهُنَّ وَلَدٌ ۚ فَإِنْ كَانَ لَهُنَّ وَلَدٌ فَلَكُمُ الرُّبُعُ مِمَّا تَرَكْنَ ۚ مِنْ بَعْدِ وَصِيَّةٍ يُوصِينَ بِهَا أَوْ دَيْنٍ ۚ وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ إِنْ لَمْ يَكُنْ لَكُمْ وَلَدٌ ۚ فَإِنْ كَانَ لَكُمْ وَلَدٌ فَلَهُنَّ الثُّمُنُ مِمَّا تَرَكْتُمْ ۚ مِنْ بَعْدِ وَصِيَّةٍ تُوصُونَ بِهَا أَوْ دَيْنٍ ۗ وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ ۚ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَٰلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ ۚ مِنْ بَعْدِ وَصِيَّةٍ يُوصَىٰ بِهَا أَوْ دَيْنٍ غَيْرَ مُضَارٍّ ۚ وَصِيَّةً مِنَ اللَّهِ ۗ وَاللَّهُ عَلِيمٌ حَلِيمٌ

তোমালোকৰ স্ত্ৰীসকলৰ পৰিত্যক্ত সম্পত্তিৰ অৰ্ধাংশ তোমালোকৰ বাবে, যদি সিহঁতৰ কোনো সন্তান নাথাকে আৰু সিহঁতৰ সন্তান থাকিলে তোমালোকৰ বাবে সিহঁতৰ পৰিত্যক্ত সম্পত্তিৰ চাৰি ভাগৰ এভাগ; অছিয়ত পালন আৰু ঋণ পৰিশোধ কৰাৰ পিছত। তোমালোকৰ সন্তান নাথাকিলে সিহঁতৰ বাবে তোমালোকৰ পৰিত্যক্ত সম্পত্তিৰ চাৰি ভাগৰ এভাগ, আৰু তোমালোকৰ সন্তান থাকিলে সিহঁতৰ বাবে তোমালোকৰ পৰিত্যক্ত সম্পত্তিৰ আঠ ভাগৰ এভাগ; তোমালোকে যি অছিয়ত কৰিবা সেয়া প্ৰদান কৰাৰ পিছত আৰু ঋণ পৰিশোধ কৰাৰ পিছত। আৰু যদি কোনো পুৰুষ অথবা নাৰীৰ ‘কালালাহ’ বা পিতৃ-মাতৃ আৰু সন্তানহীন উত্তৰাধিকাৰী হয়, আৰু কেৱল তাৰ এজন ককায়েক-ভায়েক অথবা এজনী বায়েক-ভনীয়েক থাকে তেন্তে প্ৰত্যেকৰে বাবে ছয় ভাগৰ এভাগ। সিহঁত ইয়াৰ অধিক হ’লে সকলোৱে তিনি ভাগৰ এভাগত সমান অংশীদাৰ হ’ব; এইবোৰ বন্টন কৰা হ'ব, যিটো অছিয়ত কৰা হয় সেইটো পালন কৰাৰ পিছত আৰু ঋণ পৰিশোধ কৰাৰ পিছত, কাৰো ক্ষতি নকৰাকৈ। এইটো হৈছে আল্লাহৰ নিৰ্দেশ; আৰু আল্লাহ সৰ্বজ্ঞ, সহনশীল।

[4:11] GOD (Ellahu) advises you (p) (Yuusii-kumu) regarding (Fii) your children (Aw'laadi-kum). For the 

male (Liz' Zakari) is like (Mith'lu) the share (Hazzi) of two females (El'Unthayai'ni). But (Fa) if (In) there are 

(Kunna) women (Nisaa'an) beyond (Faw'qa) the two females (Eth'natai'ni), then (Fa) for them (Lahunna) is 

one-third (Thulutha) of what (Maa) is bequeathed (Taraka). And (Wa) if (In) there is (Kaanat') one-female 

(Waahidatan), then (Fa) for her (Laha) is half (En'Nis'fu). For (Li) one's two parents (Abawai'hi), to (Li) each 

(Kulli) one (Waahidin) of them (Min'huma) is one-sixth (Es'Sudusu) of what (Mimma) is bequeathed 

(Taraka), if (In) he has (Kaana Lahu) a child (Waladu). But (Fa) if (In) he does (Yakun) not (Lam) have (Lahu)

a child (Waladun), and his two parents (Abawaa-hu) inherits him (Waritha-hu), then (Fa) one-third 

(Et'thuluthu) for (Li) his mother (Ummi-hi). But (Fa) if (In) he has (Kaana Lahu) brothers (Ikh'watun), then 

(Fa) one-sixth (Es'Sudus) for (Li) his mother (Ummi-hi). After (Min Ba'di) a legal will (Wasiyyatin) has been 

prescribed (Yuusii Bihaa) or (Aw') debt (Dai'nin). Your parents (Aabaau-kum) and (Wa) your children 

(Ab'naau-kum); you do not (Laa) know (Tad'ruuna) which of them (Ayyuhum) is nearest to you (Aq'rabu La-

kum) in benefit (Naf'ån); an obligation (Fariidotan) from GOD (Minallahi). Indeed, GOD (Innallaha) is 

(Kaana) Omniscient (Åliiman) and Wise (Hakiimaa).

[4:12] And (Wa) for you (Lakum) is half (Nis'fu) of what (Mimma) your spouses (Az'waaju-kum)

bequeathed (Taraka), if (In) they had (Yakun Lahunna) no (Lam') children (Waladun). But (Fa) if (In) they 

have (Kaana Lahunna) a child (Waladun), then (Fa) for you (Lakum) is one-fourth (Er'Rubu-u) of what 

(Mimma) they bequeathed (Tarak'n), after (Min Ba'di) a legal will (Wasiyyatin) has been prescribed 

(Yuusiina Bi-haa) or (Aw') debt (Dai'nin). And (Wa) for them (f) (Lahunna) is one-fourth (Er'Rubu'u) of what 

(Mimma) you bequeathed (Tarak'tum'), if (In) you had (Yakun Lakum) no (Lam) children (Waladun). But (Fa)

if (In) you have (Kaana Lakum) a child (Waladun), then (Fa) for them (Lahunna) is one-eighth (Et'thumunu)

of what (Mimma) you bequeathed (Tarak'tum), after (Min Ba'di) a legal will (2:240📍) (Wasiyyatin) has been 

prescribed (Tu'suuna Bihaa) or (Aw') debt (Dai'nin). If (In) a man (Rajulun) had (Kaana) no parents or 

children (Kalaalatan) inheriting (Yuurathu) or (Awi) a wife (Em'ra'atun), but (Wa) has (Lahu) a brother 

(Akhun) or (Aw') a sister (Ukh'tun), then (Fa) for (Li) each (Kulli) one (Waahidin) of them (Min'huma) is one-

sixth (Es'Sudusu). But (Fa) if (In) they are (Kaanuu') more (Ak'thara) than (Min) that (Zaalika), then (Fa) they 

(Hum) will be partners (Shurakaau) in (Fii) one-third (Et'thuluthi), after (Min Ba'di) a legal will (Wasiyyatin)

has been prescribed (Yuusaa Bi-haa) or (Aw') debt (Dai'ni) without (Gai'ra) damage (Mudoarrin); a legal 

will (2:180📍) (Wasiiyyatan) from GOD (Minallahi). For (Wa) GOD (Ellahu) is Omniscient (Åliimun) and 

Clement (Haliimu).

4:11✓

Now Allah explains to you the Laws of inheritance: 

1. The portion of a son is equal to the portion of two daughters,

2. If there are two or more daughters, they shall have together 2/3rds of the inheritance,

3. If there is only one daughter, her share shall be one half of the inheritance,

4. The father and mother of the deceased shall each have one-sixth of the inheritance, if he left children,

5. If the deceased left no children and his parents alone are the heirs, his mother shall have one-third (and 

his father two-thirds) of the inheritance, but if he left brothers or sisters along with his parents, his mother 

shall have one-sixth of the inheritance. (The shares of his brothers and sisters are determined under 12(3). 

The distribution of inheritance, in all cases, is after the provisions of the deceased s will have been 

fulfilled and his debts have been paid. Allah has appointed these shares because you could not know who 

amongst the inheritors of the deceased are deserving and to what extent. Certainly Allah is All-Knowing, 

Wise. 

4:12 √

1. You shall have one-half of what your wives leave behind if they leave no child, but if they 

leave a child, you shall have one-fourth of what they have left behind. This is after the provisions of the 

deceased s will have been fulfilled and her debts have been paid.

2. Your wives shall have one-fourth of what you have left behind, if you have no child, but if 

you have child, they shall have one-eighth of what you leave behind, after the provisions of your will 

have been fulfilled and your debts have been paid.

3. If the deceased leaves no children and his heirs are parents and brothers and sisters*, then:-

a) In case there is one brother and one sister, each of them gets one-sixth of the inheritance,

b) in case there are more than two then together they will get one-third of the inheritance. 

This is after the provisions of the deceased s will have been fulfilled and his debts have been paid. The distribution of the inheritance should be in such a way that no loss is caused to anyone. This is an injunction from Allah, Who knows ALL and is not carried away by emotions.
